Mediation

Long an advocate of alternatives to trial, including mediation, arbitrations, and collaborative law, Tom Carnes acts as a third-party neutral mediator in family law, business, construction and real estate, and consumer disputes. With Tom as a mediator, you get the experience of someone who not only has experience as a mediator, but who also serves and continues to regularly serve parties in mediations and in collaborative negotiations.

Tom mediates both disputes in which all parties have counsel, but also mediates cases in which the parties are (pro se) (not represented by counsel). In the family law context, Tom has developed a special model for such pro se mediations that is unique in that the final product of the mediation is not only a mediated settlement agreement, but an Agreed Order to present to the Court for approval.

Tom’s offices at Agarita Creek Farms near Fredericksburg provide the perfect setting for a mediation. There is an ample conference room for joint meetings, and separate space for parties to meet privately with their respective attorneys, or to confer with Tom and their counsel, if any, in complete privacy. Lunch is served, which is generally a working lunch. The rural location of the office, on a 170 acre ranch with stellar views and room to roam, provides for the most relaxed mediation atmosphere possible.

Tom’s rate for mediation is $1,000 per day, per party or side, with lunch and refreshments provided. Mediations generally commence at 9:30 a.m. This full-day rate is pro-rated if the mediation ends prior to 2:00 p.m. There is an additional hourly charge if a mediation proceeds past 5:30 p.m., and dinner will be provided, at an additional charge, if desired.
